COHOES, N.Y./EWORLDWIRE/July 24, 2003 --- Minds-Eye-View, Inc. (MEV), the pioneer in interactive spherical imaging, widely used on the internet, announced it has publicly filed its defense in the U.S. District Court Eastern District of Tennessee at Knoxville to the patent infringement and unfair competition lawsuit (case number 3:03-CV-317) filed against it by one of its licensees, Internet Pictures Corporation (Nasdaq:IPIX) of Knoxville, Tennessee. MEV considers the iPIX lawsuit meritless, frivolous, and vexatious.
In its defense, MEV has presented irrefutable evidence that there is no unfair competition and that the patent in suit (Re. 36,207) is invalid, unenforceable, and not infringed on numerous grounds, including: immunity from suit, anticipation (prior art), improper inventorship, inequitable conduct (including fraud in procurement), non-enablement, failure to disclose best mode, and inadequate written description, the result of which is expected to render the entire iPIX patent portfolio unenforceable.
